About our privacy policy
Active Ants BV cares about your privacy. We therefore only process the personal data we need to provide and improve our services and will treat any information we have gathered about you and your use of our services with the utmost care and attention. We will never release your personal data to third parties for commercial purposes.

This privacy policy applies to the use of the website activeants.nl and the communication from Active Ants BV available on this website. These terms and conditions entered into force on 18 May 2018. If and when a new version of these terms and conditions is published, all previous versions shall lapse. This privacy policy specifies what data we collect about you, the purposes for which these data are used, the conditions under which these data may be shared with third parties and who these third parties are. We also explain how we store your data, what measures we have taken to protect your data against misuse and what your rights are with regard to the personal data you have provided to us.

Website software
Silverstripe

Our website was developed in-house using Silverstripe software. Any personal data you provide to us via our website for the purpose of our service provision are processed using this software. We will never use your personal data for any other purposes and have taken appropriate security measures to protect your data. These measures consist of the use of SSL encryption and a strict password policy.

Email and mailing lists
MailChimp

Our website uses MailChimp, a third party that handles all email traffic from our website and the sending of our newsletters. All confirmation emails you receive from our website and all web forms are sent via MailChimp's servers. MailChimp will never use your name or your email address for its own purposes. You can find an “unsubscribe” link at the bottom of any email that is automatically sent via our website. If you click on this link, you will no longer receive any emails from our website. Note that this may seriously compromise the functionality of our website! Your personal data are securely stored by MailChimp. MailChimp uses cookies and other forms of internet technology that provide insight into whether emails are opened and read. MailChimp reserves the right to use your personal data to further improve its services and share information with third parties for this purpose.

Office 365
For our standard business email traffic, we use the services of Office 365. This party has taken appropriate technical and organisational measures to prevent the misuse, loss and corruption of your and our data as much as possible. Office 365 does not have access to our inbox and we treat all our email traffic with confidentiality.

Purpose of the data processing
We only use your data for the purpose of our service provision. This means that the purpose of our data processing always pertains directly to the assignment you have given us. We do not use your data for (direct) marketing purposes. If you share data with us and we use these data to contact you in an unsolicited manner at a later time, we will always ask for your explicit permission to do so. We do not share your data with third parties, except for the purpose of meeting our accounting and other administrative obligations. These third parties are all required to treat your data with confidentiality on the grounds of the agreement we have signed with them or an oath or legal obligation.

Automatically collected data
Data that are automatically collected by our website are processed for the purpose of further improving our services. These data (e.g. your IP address, web browser and operating system) are not personal data.

Cooperation with fiscal and legal inquiries
In some cases, Active Ants BV may be legally obligated to share your personal data for the purpose of a fiscal or legal inquiry conducted by a government body. In such cases, we are forced to share your data, although we will use every legal avenue available to us to resist this obligation.

Storage periods
We will store your data for as long as you remain a client of ours. This means we will store your client profile until you inform us that you no longer wish to make use of our services. When you do so, we will interpret this as a request to be forgotten. On the grounds of applicable administrative obligations, we are required to store invoices that contain your (personal) data. These data will therefore be stored for the duration of the applicable storage period. However, our staff can no longer access your client profile or any of the documents that were produced for the purpose of our service provision to you.

Your rights
On the grounds of applicable Dutch and European legislation, you have certain rights as a data subject with regard to your personal data that are processed by or on behalf of us. Below, we will explain what these rights are and how you can exercise them.

In principle, we will only send copies of your personal data to your registered email address in order to prevent misuse of the data. If you want us to send your personal data to you via a different email address or e.g. via regular mail, we will ask you to submit some form of identification. We keep a record of processed requests. If we receive a request to be forgotten, these records will contain anonymised data instead. Copies of your data will be sent to you in the machine-readable data format that we use in our systems.

At all times, you have the right to file a complaint with the Data Protection Authority if you suspect that we have misused your personal data in any form whatsoever.

Right of access
At all times, you have the right to access any data that we process that concern you or can be traced back to you. Please submit your request to our contact for privacy-related matters. You will receive a response to your request within thirty days. If your request is granted, we will send a copy of all data and an overview of the processors with whom we have shared your data, including the category under which we have stored these data, to your registered email address.

Right to rectification
At all times, you have the right to have any data that we process that concern you or can be traced back to you rectified. Please submit your request to our contact for privacy-related matters. You will receive a response to your request within thirty days. If your request is granted, we will send a confirmation of the rectification of the data to your registered email address.

Right to restriction of processing
At all times, you have the right to restrict the processing of any data that we process that concern you or can be traced back to you. Please submit your request to our contact for privacy-related matters. You will receive a response to your request within thirty days. If your request is granted, we will send a confirmation that the data will no longer be processed until you lift the restriction to your registered email address.

Right to data portability
At all times, you have the right to have the processing of any data that we process that concern you or can be traced back to you carried out by a different party. Please submit your request to our contact for privacy-related matters. You will receive a response to your request within thirty days. If your request is granted, we will send copies of all data concerning you that we have processed or that have been processed by other processors or third parties on our behalf to your registered email address. In most cases, we will not be able to continue providing our services to you, since the secure connection of data files can no longer be guaranteed.

Right to object and other rights
If applicable, you have the right to object to the processing of your personal data by or on behalf of Active Ants BV. If you exercise this right, we will immediately suspend the processing of your data while your request is being handled. If your objection is justified, we will submit copies of personal data concerning you that we process or that are processed by other parties on our behalf to you and then permanently terminate the processing of your data.

Furthermore, you have the right to object to automated individual decision-making or profiling. We do not process your data in such a manner that this right is applicable. If you believe this to be untrue, please notify our contact for privacy-related matters.

Google Analytics

Via our website, the American organisation Google places cookies on your device as part of their Analytics service. We use this service to monitor and receive reports about how visitors use our website. On the grounds of applicable laws and regulations, this processor may be obligated to grant insight into these data. We have not given Google permission to use the acquired Analytics data for other Google services.
